P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees
in that
employees were exposed to the hazard of being thrown out of the basket of
a telescoping boom
lift:
a)On or about May 7, 2009, an employee was observed on the north side of
the
building operating an non-vehicle mounted aerial work platform (e.g. model
XLB-4319, Hydraulic Boom Lift) with no fall protection such as but not
limited
to a full body harness and lanyard, which exposed the worker to an 11-foot
fall
hazard.
One feasible and acceptable abatement method to correct this hazard is to
have
employees don a safety harness and lanyard before entering the basket and
attach
the lanyard to appropriate device in the basket.
