P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of getting thrown out of the operator's seat and being crushed by the industrial lift truck: : A) Warehouse area - On or about June 9, 2009, employees was observed operating industrial lift trucks (forklift) without wearing the seatbelt. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED. One feasible and acceptable abatement methods to correct this hazard is to assure that employees who operate forklifts wear the seatbelt.
