P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by or punctured by projectiles from ruptured compressed air distribution system piping: a)In the production building, on or about September 2, 2009 and at times prior to, employees were exposed to being struck-by or punctured by high velocity projectiles during the rupture of polyvinyl chloride (PVC) pipe with a line pressure of more than 100 pounds per square inch (psi) being used to transport compressed air throughout the structural steel production building to operate automatic welding equipment, plasma cutters, pneumatic tools such as an air chisels, and a spray painting system. The piping was not approved for use with compressed air. Fragmentation of the pipe could occur due to fatigue caused by cold contents and/or vibrations, the compressor shifting position and placing additional stress on the PVC pipe connector, or the pipe being struck by equipment and materials. Among other methods, feasible and acceptable means of abatement is to: 1) Ensure that compressed air distribution pipe be used in accordance with the American Society of Mechanical Engineers (ASME) B31.9-2008, Building Services Piping, Section 923.3.2 which states that, " If thermoplastics are used for compressed air or other compressed gases, special precautions must be observed. The stored energy and specific failure mechanism of the pipe need to be considered. Materials such as PVC, CPVC, and PVDF, which exhibit brittle failure as defined in ASTM F 412, shall not be used for compressed air or gas service." 2) Ensure that all non-shatter resistant thermoplastic piping that is used to transport compressed air or other compressed gases be buried underground or encased in shatter-resistant materials in accordance with Recommendation B, Thermoplastic Piping for the Transport of Compressed Air or Other Compressed Gases, which was adopted by the Plastics Pipe Institute in October 1977.
