P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: Struck by and crushing hazard when separating 1,550 gallon Captor tank containment systems. a)At the south east corner of the water treatment plant, Building 4004, on or about September 29, 2009, and at times prior to, the employer did not follow the manufacturer's recommendations in that they attempted separation and modification of the two tanks, which is not recommended by the tank manufacturer, as a result the employees were exposed to struck by and crushing hazards. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: 1.Ensure employer consult with product manufacturer before attempting separation and or modification of its products, such as but not limited to, 1,550 gallon Captor containment systems. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.
