P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by vehicular traffic
while working in the
street:
a)On Hodgson Memorial Drive, North of Oglethorpe Professional Blvd., on or
about December 4, 2009, an employee placed cones in the North lane of the
street exposed to heavy vehicle traffic.
One feasible and acceptable means of abatement is to ensure all employees
wear
reflective vests or other reflective clothing while exposed to vehicular
traffic.
