P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of:
a)At the rail car (un)loading area, on or about and at times prior to
February 4,
2010, employees were exposed to struck-by hazards because testing was not
perform on nor did the employer ensure that the manufacturer's
identification was
stamped on the hook used to pull empty and loaded rail cars for animal feed
manufacturing operations.
FEASIBLE MEANS OF ABATEMENT:
One feasible means of abatement, among others, would be to ensure that the
hook being
used to pull the rail cars complies with the American Society of
Mechanical Engineers
(ASME) B30.10-1999, which requires the hook to be tested, inspected, and
stamped with
the manufacturer's identification.
ABATEMENT CERTIFICATION IS REQUIRED.TION
