Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling while accessing the
elevator hoistway and/or
being struck by the moving elevator car while in the hoistway.
For the Coker Elevator:  The elevator car did not have the top emergency
hatch covered and
fastened to allow opening from the top only.  The top emergency exit must
be covered and
secured in accordance with the Safety Code for Existing Elevators and
Escalators, American
Society of Mechanical Engineers (ASME) A17.3, 1996, Section 3.4.4 (a) (1).
This hazard
was not identified where the employer failed to have the elevator
inspected, tested and
maintained in accordance with the Safety Code for Elevators and
Escalators, ASME A17.1,
1996, Part X - Routine, Periodic and Acceptance Inspections and Tests.
Feasible abatement methods for this violation include, but may not be
limited to, maintaining
and inspecting the elevator in accordance with ASME A17.1 and A17.3 -
1996.  Abatement
certification must be submitted for required repairs to the top emergency
exit and
documentation of the required annual inspection.on
