Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees installing a cable barrier in the center median on Interstate Highway 35 near Purcell, Oklahoma. The employer did not ensure that employees were protected from traffic while working in the center median on Interstate Highway 35. The speed limit on the Highway at this location is seventy (70) miles per hour. Employees are exposed to the hazard of being struck by oncoming traffic and/or struck by parts or debris from traffic. On September 8, 2007, employees were drilling holes in the center median in preparation for cable barrier installation. There were no warning signs to inform drivers of an active work zone. There were no signs lowering the speed limit in the work area. The inside lanes of the highway that were closest to the work activity were not closed. Two employees were fatally injured when they were struck by a wheel and tire that came off of a dual axle box trailer that was being towed in the inside north bound lane. One feasible and useful abatement method would be to ensure the standards and guides for traffic control in Part 6 of the Manual on Uniform Traffic Control Devices are followed.
