Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to explosion or violent release of fluid and or gas from a high pressure system connected to a gas well. For the employees operating on the pump on or about May 28th, 2008; the employer did not ensure a person was qualified in well control procedures. Among other methods of feasible abatement, the employer should have a competent person operating the pump during well control operations.

For the employees working on or around the well head on or about May 28th, 2008; the employer did not ensure all pipe fittings, valves, and unions connected to the blowout preventer had a working pressure equal to or greater the the maximum anticipated well surface pressure.ed
