Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to caught-in-between and struck-by hazards while performing crane maintenance. At the worksite: On or about June 11, 2008, and at times prior thereto, employees performed maintenance on a Terex RT160 crane without taking measures to ensure the stability of the crane. The improper maintenance procedures contributed to a crane tip-over on June 11, 2008. Among others, one feasible and acceptable method of abatement would be to comply with the requirements outlined in the Terex RT160 equipment manuals.
