Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure places of employment were free from recognized hazards as follows: a.On April 02, 2007 at the facility, an employee was using a JMC Recycling Systems 320 Shear to cut and shorten aluminum, copper, brass and stainless steel metal pieces. The employee was apportioned a mix of metal pieces and two oxygen cylinders that were still under pressure. The employee decided to use the alligator shears to cut one of oxygen cylinders into smaller pieces. The cylinder exploded and the employee's right wrist was almost completely severed from the rest of his arm. Also, the employee had a severe laceration on the lower left hand. Reference: JMC Recycling Systems 320 Shear Operation and Maintenance Manual: Section 2.2 Warning Labels, Safety Instruction #6. Do not attempt to shear pressurized containers, ammunitions, hardened steels, metals likely to fly from the blades of the shear, inflated tires or any other substances likely to injure the operator or a bystander. DO NOT UNDER ANY CIRCUMSTANCES ATTEMPT TO SHEAR: Totally enclosed vessels, cylinders, gas containers, aerosols or any other pressurized container. One feasible means of abatement would be to follow all prevailing safety regulations, including those in the Operation and Maintenance Manual for the JMC Recycling Systems 320 Shear.s
