Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure that employees were wearing and using fall
protection equipment
while working from an aerial lift, as follows:
a.At Blue Diamond Business Building No. 9, 8298 Arville Street, Las Vegas,
NV
89139, two employees were exposed to a fall hazard of approximately 25 to
30
feet to the ground due to the lack of fall protection.

Section 5.15.1 Elevating Personnel: (k) be certain that required straining
means
such as railings, chains, cable, body belt(s) with lanyard(s), etc., are
in place and
properly used;
One feasible means of abatement would be to don proper fall protection per
the
section 5.15.1 (k) above.

The employer failed to ensure that employees were maintaining a firm
footing on the platform
floor while working therein, as follows:
a.At Blue Diamond Business Building No. 9, 8298 Arville Street, Las Vegas,
NV
89139, two employees were exposed to a fall hazard of approximately 25 to
30
feet to the ground while standing on the midrail of the personnel platform
to gain
additional height.

Section 5.15.1 Elevating Personnel: (u) personnel are to maintain firm
footing on
platform floor unless secured by body belt and lanyard. Use of railings,
planks,
ladders, etc., on the platform for purpose of achieving additional reach
or height
is prohibited;
One feasible means of abatement would be to direct the rough terrain
forklift
operator to elevate the personnel lift higher in order to safely reach
material, or
obtain an aerial lift or scissor lift that would be more suitable for
elevating
workers safely into difficult positions while elevated to significant
heights.ant
