Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure that employees were not transported while
sitting on the front
bucket of a backhoe/loader as follows:
a.At Motorcoach Resort, 8175 South Arville, Las Vegas, NV 89139,
Backhoe/Loader operations, two employees were exposed to falling in front
of a
moving backhoe/loader (make: CATERPILLAR, model no. 416C, serial no.
0545, equipment id. no. 00-773) while sitting on the front bucket, which
subjected them to incur bodily injuries such as fractures, crushing of
limbs,
and/or death.

Page 16 Before Starting Engine, Fifth Paragraph: Before you start the
engine and before you move the machine, make sure that no one is
underneath the machine, around the machine, or on the machine. Make
sure the area is free of personnel.
Page 17 Machine operation, Third Paragraph: Do not allow riders on the
machine unless the machine has the following equipment:
--additional seat
--additional seat belt
--Rollover Protective Structure (ROPS)

Page 17 Warn Personnel Before Starting, First Paragraph: Before starting,
walk completely around the equipment. Make sure no one is under the
machine, ont, or close to it. Let other workers and bystanders know you
are starting up and don't start until everyone is clear of the machine.
Page 21 Remember The Other Person, Warning: Your backhoe/loader is
a one-person machine. Never permit riders.
One feasible means of abatement would be to transport workers in an
automobile
suitable for surface street travel and properly equipped with safety belt
restraints.

trained to operate
such equipment as follows:

Page 8 For Safe Operation, First Paragraph: For safe operation of this
machine,
you must be a qualified and authorized operator. To be qualified, you must
understand the written instructions supplied by the manufacturer, have
training,
including actual operation of this machine and know the safety rules and
regulations for the jobsite.
One feasible means of abatement would be to require all backhoe/loader
operators
to successfully complete a training course that would include the
prohibition of
transporting workers on such equipment.
