Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from heights: Date: On or about 6/15/2007 & approximately 10:00am. Location: On the south side of the Holiday Inn Express, entrance side of the building, located & 4970 Harrison Road, Macon, Georgia 31210 Condition: Employee was observed working from an elevated work platform approximately 28 feet above the ground level on a Lull #412-06-8400 #644B-42 Model Rough Terrain Forklift Truck without a personal fall arrest system or guardrail system. The employee was using the Lull rough terrain forklift to ride the forks and mask to the access the third floor in order to get the welding machine. Among other means, one feasible and acceptable abatement method would be to provide a platform which complies with the design requirements listed in the American Society of Mechanical Engineers B56.6-1992 Section 5.15 Elevating Personnel. The employee was instructed to get down and not perform this unsafe operation again. Abatement was completed on the job site the day of the inspection 6-15-2007. No abatement certification or documentation is required for this item.
