Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards as the boiler exploded due to piping
that was installed
backward during initial installation.
The employer did not assure all components of the boiler were installed
correctly. Testing
identified the #2 fuel oil burner input and return piping was reversed
during original installation
and nozzle screens were partially clogged.
"Among other methods, feasible and acceptable abatement methods to correct
this hazard is to:"
1. Test boiler equipment upon initial installation to assure correct
installation of the boiler and
all associated equipment. (Reference NFPA 85 Boiler and Combustion Systems
Hazards Code,
2001 Edition, section 1.5 Installation).
2. Follow manufacturer recommendation on application.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.

The employer did not produce a Maintenance program that addresses tasks
employees performed
including written comprehensive maintenance procedures incorporating the
manufacturer's
instructions to define the tasks and skills required.
"Among other methods, feasible and acceptable abatement methods to correct
this hazard is to:"
1. Create a Maintenance Program that includes well defined planning for
making repairs or
modifications using qualified personnel, tools and instruments designed
for the work and written
comprehensive maintenance procedures incorporating the manufacturer's
instruction to define
the tasks and skills required. (Reference NFPA 85 Boiler and Combustion
Systems Hazard
Code, 2001 Edition; section 1.7 Maintenance, Inspection, Training and
Safety).
2. Follow manufacturer recommendation on application.

employer did not

were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards as they were not provided training for
switching the dual fuel
2005 Hurst boiler from natural gas to #2 Diesel fuel.
While attempting to switch the boiler from natural gas to diesel the
technician did not recognize
piping on the boiler had been installed backward causing an overload of
diesel fuel into the
boiler resulting in the boiler exploding and boiler parts striking the
employee.
"Among other methods, feasible and acceptable abatement methods to correct
this hazard is to:"
1. Create a training schedule for employees in a Maintenance Program that
includes well defined
planning for switching dual fuel boilers from natural gas to #2 diesel
including recognition of
part installation and/or equipment failure. (Reference NFPA 85 Boiler and
Combustion Systems
Hazards Code, 2001 Edition; section 1.7 Maintenance, Inspection Training
and Safety, 1.7.2
Maintenance Training).
2. Follow manufacturer recommendation on application.
