Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish equipment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to dust explosion, deflagration, or other fire hazards from
dust
collectors being
located inside a building.
(a) Semi-Bulk injector (Milling) area - A Torit dust collector used to
collect flammable
dust was located inside the process building on and prior to 03/13/2008.
(b) Semi-Bulk injector (Milling) area - An installer of fire extinguishing
equipment,
familiar with combustible dust hazards and local fire codes, was not
consulted for
recommendations and installation of the proper fire extinguishing and
explosion relief
equipment for a Torit dust collection system on and prior to 03/13/2008.
(c) Semi-Bulk injector (Milling) area - Vents installed on a Torit dust
collection system,
located within a building, were not vented to the outside to minimize
chances of a
secondary explosion, deflagration, or other fire hazard on and prior to
3/13/2008.
(d) Semi-Bulk injector (Milling) area - Ductwork from the dust collection
system
to the
Semi-Bulk injector was not constructed of metal to minimize chances of a
secondary
explosion, deflagration, or other fire hazard on and prior to 3/13/2008.
AMONG OTHER METHODS, A FEASIBLE ABATEMENT METHOD TO CORRECT
THIS HAZARD IS TO CONSULT AND COMPLY WITH NATIONAL AND LOCAL
FIRE SUCH AS NFPA 654, Standard for the Prevention of Fires and Dust
Explosions
from the Manufacturing, Processing, and Handling of Combustible
Particulate Solids
WHEN DETERMINING THE LOCATION AND OPERATION OF DUST
COLLECTION EQUIPMENT.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this
violation (using the CERTIFICATION OF CORRECTIVE ACTION
WORKSHEET), and in addition, documentation demonstrating that abatement is
complete must be included with your certification.  This documentation may
include,
but is not limited to, evidence of the purchase or repair of the equipment,
photographic or video evidence of abatement, or other written records.
