Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A) Struck-by and rollover hazards. The employer did not ensure that the Exmark Lazer Z HP zero turn mower was: 1) Not operated near a drop-off. 2) Not operated on slopes greater than fifteen degrees. 3) Not operated at an excessive speed. 4) Not operated without roll over protection and seat belt. A feasible and acceptable means of abatement would be to follow the manufacturer's recommendations for operation listed on the equipment. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
