Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and run over by a skid steer machine with an inoperable back-up alarm. (a) Location - 6 West Main Street, Hopkington, MA: On or about June 26, 2007, employees were exposed to struck by or crushing hazards from a Mustang skid steer loader with an inoperable back up alarm. Among other methods, feasible and acceptable means of abating this condition includes but not limited to: 1. Repair or replace the back up alarm. 2. Institute a daily inspection of skid steer before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the equipment.
