Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught between the excavator rotating superstructure and the storage container: a)Container Storage Yard: The areas within the Caterpillar 330CL hydraulic excavator swinging superstructure were not protected from entry when the excavator was operating adjacent to the fixed storage container, on or about 7/16/2007. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1:Erect barricades to prevent entry into areas of the excavator swinging superstructure when operating adjacent to a fixed object.
