Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of hoist hooks without safety latches: a)41 Bleeker Street, Paterson, NJ: The hook of the unmarked 2 ton wire hoist was not equipped with a safety latch, on or about 02/21/2008. b)41 Bleeker Street, Paterson, NJ: The hook of the CM Lodestar 2 ton chain hoist was not equipped with a safety latch, on or about 02/21/2008. ABATEMENT NOTES: Among other methods, one feasible and acceptable method to correct this hazard is to equip the hoist hooks with safety latches described in ANSI B30.16-1993 Section 16-1.2.9 (Hooks). A latch shall be provided to bridge the throat opening of the hook and retain, under slack conditions, such items as, but not limited to, slings and chains.
