Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of: Being struck by moving automobiles.
a)Kinderkamack Road & Glen Lane:  Employees were collecting garbage at
early
dawn while wearing dark clothing, on or about 3/11/2008.
One method of abatement, among other feasible methods, is to require and
ensure the usage of
high visibility/reflective clothing as recommended in the Environmental
Industry Associations
Manual of Recommended Safety Practices (RSP4C001-1999).
b)Kinderkamack Road & Glen Lane:  Miele Truck #31 did not have two sets of
retroreflective sheeting applied (one at the bottom and one at the top of
the
hopper) as required, on or about 03/11/2008.
One method of abatement, among other feasible methods, is to install
retroreflective sheeting
at both the top and the bottom of the hopper as required by ANSI
Z245.1-1999-7.2.16.5.1.1.
c)Kinderkamack Road & Glen Lane:  Miele Truck #31 did not have a horizontal
strip of sheeting in alternating colors applied, originating and
terminating as close
to the front an truck body as practicable, on or about 03/11/2008.
One method of abatement, among other feasible methods, is to install
horizontal strips of
sheeting in alternating colors to both sides of the hopper as required by
ANSI Z247.2.16.5.2.

were exposed to: the hazard of falling off the rear of the truck.
a)Montvale NJ:  Miele Truck #31 had riding steps that were only 6.5 inches
deep,
on or about 03/11/2008.
One method of abatement, among other feasible methods, is to install new
riding steps that
extend 8 inches as required by ANSI Z245.1-1999-7.2.9(e)
b)Montvale NJ:  Miele Truck #31 - Employees were using the right side
riding step
where only one grab handle was available for use (second handle was broken
off),
on or about 03/11/2008.
One method of abatement, among other feasible methods, is to install the
secondary handle as
required by ANSI Z245.1-1999-6.2.5.4(e).
