Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a backhoe bucket: a)Parking Lot: Worker was not protected from being struck by the Caterpillar Model 416C backhoe bucket, on or about 8/26/2008. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1:Before you move the backhoe boom/bucket to either side, make sure that all persons are out of the way. 2:Make sure the area is clear of all persons before you start operating the machine.g
