Section 5(a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to falling from an
elevation:
a)Plaza 46 (Route 46 West), West Paterson, NJ: Employee
was lifted by a Caterpillar 416C Backhoe loader bucket,
to remove holiday decorations, on or about 01/06/2009.
Among other methods, feasible and acceptable abatement methods to
correct this hazard are:
1.  Use a ladder.
2.  Use a aerial lift.
3.  Use a pole from the ground level.
