Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and crushing hazard: On or about 4/10/07, employees were operating forklifts over a dock leveler with a lip that did not properly set into the safety latches. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this method is to maintain the Serco dock leveler in accordance with the manufacturer's instructions and ensure that it is operating correctly.
