Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about 6/20/2007, employees from Knowly's Johnson Inc. were applying stucco to a ceiling in one of the offices within the Miramar Aquatic Center, when the ceiling fell down on the employees. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that the company follows the specifications as outlined in the engineering plans and when there is a question regarding the plans, the company contacts the General Contractor for more clarification by writing a request for information (RFI).
