Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while directing the flow of heavy equipment vehicles: On or about 11/08/07, at the Sun Recycling Facility III, a signaling flagger assigned to direct traffic at the entrance of the unloading area, was not wearing a high visbility warning garment. Among others, one feasible and acceptable method of abatement is to have the flagger direct the flow of traffic from a designated spot and enforce the use of high visbility warning garments that conform to Part VI of the Manual of Uniform Traffic Control Devices which are incorporated by reference in 1926.200(g)(2). PLEASE NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
