Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to struck-by
hazards:
On or about 11/17/07, at 33100 Tamiami Trail Racoon Point #2, an employee
was exposed to
an injury after striking against a rod basket while guiding a testing rod
onto a holding rack due
to the derrick operator's failure to observe and control the load, to
include but not limited to
inadequate communication.
Among others, one feasible and acceptable method of abatement is to
develop and implement
in accordance with API RP 54, Recommended Practice for Occupational Safety
for Oil and Gas
Well Drilling and Servicing Operations, Section 9.6.7 loads shall not be
allowed to come in
contact with any part of the derrick, mast or other stationary equipment,
as well as, Section 12.3
to provide and use adequate communication methods.ation
