Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a chemical burn and/or fall hazard: On or about 03/24/08, during preparations to remove a reclaim tank from the bleach plant, a maintenance worker climbing a 24 foot fiberglass extension ladder, while wearing slick rubber boots, was exposed to a fall and/or chemical burn hazard from climbing/working above the spill containment area which was heavily contaminated with caustic liquid and sludge. Among other methods, one feasible and acceptable abatement would be to conduct the work off of an aerial lift.
