Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards while directing traffic and reconnecting
the trailer section of
a semi-truck to the tractor that became dislodged in the middle of the
highway while enroute to
a delivery.  Among other methods, one feasible and acceptable method to
correct this hazard is
for the employer to provide and require the use of high-visibility safety
garments such as, but
not limited to reflective vests for drivers in the event of a vehicular
breakdown in or near the
highway:
a) Shoulder of Highway US Hwy 321 near Exit 41:  On or about August 6,
2010,
employees engaged in the operation, towing and connection of semi tractor
trailer trucks
while in close proxmity to the highway were not wearing high-visibility
safety
apparel
while adjacent to vehicular traffic.
b) Middle of Highway 321 near Exit 41: On or about August 6, 2010,
Employees
engaged in the reattachment of the trailer section of a semi truck that
came dislodged in
the middle of the roadway thereby blocking traffic lanes were not wearing
high-visibility
safety apparel while outside of the vehicle directing oncoming traffic.
