Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)Canyon Creek Logging, Fort Apache Indian Reservation, Road 55H,
Vicinity of Bonito
Rock Cienga:  The employer failed to develop and implement an effective
emergency
communications plan so that he can communicate from remote logging areas to
Whiteriver, AZ where the nearest emergency services are located.  An
employee was
fatally injured when struck by a blow down tree on June 6, 2007, there was
no way to
call for emergency services from the accident location.
Abatement Note:
Among other methods, one feasible and acceptable abatement method to
correct the
hazard is to find effective emergency communications devices that permit
communication
from any logging site down to Whiteriver.  These devices may include:
1.Use the Bendix King Radios that Bureau of Indian Affairs and Fort Apache
Timber
Company employees use on a regular basis to communicate from remote
logging areas
down to their home bases.
2.Use a satellite phone that provides service from the remote logging site
down to
Whiteriver.
