Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck-by and crushing hazard:
(a)Down stairs receiving area:  Employee operating a Komatsu, FG25ST-16,
forklift without having fastened the seat belt is exposed to ejection.
Feasible an acceptable methods of abatement to correct this hazard
include, but are not
limited to the following:
1)Conform to the requirements of the Komatsu, FG25ST-16 Operators
Manual, page 2-5 that states, "Always fit your seat belt correctly when
operating...there is a danger of serious personal injury if the lift truck
should tip over."
2)Conform to the requirements of ASME/ANSI B56. la-1989 Addenda to
ASME/ANSI B56.1-1988, and ASME B56.1-1993 Safety Standard that
requires the use of seat belts and for manufacturers to develop a
program to retrofit older models.
