Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to collision and/or roll-over of the powered industrial truck: Work Site - On or about 06/20/2007, seat belts were not worn by employees operating the rough terrain forklift on rough terrain, adjacent to holes in the ground and adjacent to vehicular traffic. Among other methods, one feasible and acceptable means of abatement would be to require operators to wear the supplied seat belt.
