Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, where employees utilized powered industrial trucks (forklifts), seat belts were not available and or used in the following instances: (a) The seat belt of the CAT powered industrial truck (forklift) was not usable or worn by employees operating the vehicle. Specifically, the male buckle of the seat belt was missing and the seat belt was not properly attached to the seat belt bracket. The end of the seat belt was tied or knotted around the seat belt bracket. Employees used the forklift for job activities such as but not limited to taking scrap/reject plastic components to the Hempstead regrinder machine and to move other materials. (b) The Allis-Chalmers forklift (labeled #1) was not equipped with a seat belt, therefore employees could not wear a seat belt while operating the vehicle. The forklift was used for job activities such as but not limited lifting and moving blow molder dies. These conditions exposed employees to the hazards of being struck-by the forklifts in the event of a tip over accident and/or being injured from striking other objects in the event of a collision or wreck. These conditions existed on or about July 25, 2007 and times thereto. Feasible abatement methods include, providing an appropriate seat belt and requiring the use of seat belts at all times during operation of the vehicles. Additionally, the institution of an appropriate forklift program that includes employees training is required.
