Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the worksite, near the building number 4 banding and staging areas, an employee was operating a powered industrial truck (forklift) with out having the seat belt fastened. The employee was moving bundles of lumber from the banding area to the staging area. The employee was driving a Daewoo rough terrain forklift that was equipped with a usable seat belt. This condition exposed employees to the hazard of being struck by the forklift in the event of a tip over accident or from other injuries in the event of an accident involving striking another object. This condition existed on or about November 1, 2007. Among other methods, feasible abatement methods include: assuring employees receive training on the use of seat belts and enforcing the use of the seat belts.
