Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the establishment, located at 5050 North County Road, 967, Blytheville, Arkansas, employees are exposed to contact with metal pipe heated at approximately 900 to 1750 degrees in the following instances: (a)in Mill Forming Areas #1 and #2, the operators of the mills are exposed to contact with hot pipes heated to approximately between 600 and 1850 degrees. (b)employees in Heat Treat #2 area are exposed to heated pipes at approximately 900 degrees when entering or exiting the control room or when using a lever to flip the pipe into bucks. (c)employees walking through the plant, near pipes heated between the range of 600 degrees and 1850 degrees are not protected by barriers from contact with the pipe. Among other methods, two feasible and acceptable abatement methods to correct this hazard are: (1)purchase or fabricate guards to place over the pipe with openings small enough to prevent employee contact with the heated pipe (2)erect a barrier between the pipe and where employees work or pass with sufficient space between so the hazard would be guarded by distance. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19. Or in the Alterative 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by hot surfaces: At the establishment, located at 5050 North County Road, 967, Blytheville, Arkansas, employees are exposed to contact with metal pipe heated at approximately 900 to 1750 degrees in the following instances: (a)in Mill Forming Areas #1 and #2, the operators of the mills are exposed to contact with hot pipes heated to approximately between 1850 and 1750 degrees. Employees check the weld as it cools while walking alongside the pipe at a distance ranging between 16 inches to 2 feet from the pipe. (b)employees in the Heat Treat #2 area are exposed to pipe which has cooled to approximately 900 degrees when entering or exiting the control room or when using a lever to flip the pipe into bucks. (c)employees walking through the plant, near the hot pipes are not protected by barriers from contact with the pipes.
