Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
Oilfield Fishing & Rental, LLC, location 1 mile West of HWY 137 and 1/2
mile North of
CR-D- 3400, Callaway 34, #2, Stanton, Texas,  for a period of time up to
and including
June 30, 2007, the employer failed to ensure that ignition sources were
removed prior to
beginning operations.  American Petroleum Institute ( API ) Recommended
Practice 54,
Third Edition, August 1999, states in Paragraph 9.11.1 "On land locations,
pits and tanks
used to circulate flammable materials should be located a minimum distance
of 100 ft
(30.5m) from the well.  Equivalent  safety measures should be taken where
terrain and
location conditions do not permit maintaining such distance."
Among other methods, one feasible and acceptable abatement  method to
correct this hazard
is to ensure that the recommended distance is maintained and that
spark/flame arresters are
attached to internal combustion engines.
