Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
Adobe Drilling Services, LLC, Rawhide Rig, Dorcus 1906, Upton County, 30
miles South
of Odessa, Odessa, Texas. For the period of time up to and including July
14, 2007,
employees were exposed to fall hazards while performing work operations
such as spray
painting the blocks on the rig. Employees were elevated at approximately
30 feet above the
lower level by an air hoist. The air hoist cable was attached to the
safety harness with a
lanyard used as a fall arrest system. One employee was fatally injured as
he was lowered to
the rig floor by an air hoist.
American Petroleum Institute (API) Recommended Practice 54, August 1999
states
in
Paragraph 5.5.1 " All personnel, when engaged in work ten feet above the
rig floor or other
working surfaces, shall be protected at all times from falling by
guardrail systems, safety net
systems, or personal fall arrest systems (PFAS). When the employer can
demonstrate that it
is infeasible or creates a greater hazard to use these systems, the
employer shall develop and
implement an alternative fall protection plan that provides for personnel
safety."
"Pursuant to 29 CFR 1903.19(d), the employer must provide documentation
that this
violation has been abated within 10 calendar days after the abatement
date."

employees were exposed to caught by hazards while being raised and lowered
by an air
hoist. One employee was fatally injured when the lanyard attached to the
safety harness
wrapped around the kelly.
American Petroleum Institute (API) Recommended Practice 54, August 1999
states in
Paragraph 6.8.5 "No personnel shall clean, lubricate, or repair any
machinery where there is
a hazard of contact with moving parts until such machinery has been
stopped or such parts
have been properly guarded."
"Pursuant to 29 CFR 1903.19(d_, the employer must provide documentation
that this
violation has been abated within 10 calendar days after the abatement
date".
