Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while standing on the raised tines of a forklift truck. a) Worksite, 135 Baylis Road, Melville - An employee was riding in a work platform of a powered industrial truck in the lifted position approximately 14-16 feet above the cement floor. There was no safe place to ride and no personal fall arrest system in use; on or about 06/10/08. ABATEMENT NOTE: Among other methods, feasible methods of abatement to correct this hazard include, but are not limited to: 1) Enforce the proper application and use of fall arrest systems. 2) Train exposed employees about the hazard of falls associated with improper elevating methods. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
