Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed by falling concrete walls:
a)  Worksite, 232 North Sea Road, Southampton - Employees had
constructed a concrete foundation/basement in an excavation
approximately 7' deep.  The employee had just been instructed by
supervisor to waterproof the foundation wall at the southeast
stairwell when the wall suddenly collapsed due to the fact that no
footings had been poured; on or about 1/2/09
b) Worksite, 232 North Sea Road, Southampton - Employees had
constructed a concrete foundation/basement in an excavation
approximately 7' deep.  The employee had just been instructed by
supervisor to waterproof the foundation wall at the southeast
stairwell when the wall suddenly collapsed due to the fact that the
bracing used to support the wall, which had no footing, was
inadequate; on or about 1/2/09
ABATEMENT NOTE:
Among other methods, one feasible and acceptable method is to follow the
2007 Residential
Code of New York State, Section R403.1 which states "all exterior walls
shall be supported on
continuous solid or fully grouted masonry or concrete footings, wood
foundations, or other
approved structural systems which shall be of sufficient design to
accommodate all loads..."
Note:  Because abatement of this violation is already documented in the
case file, the
employer need not submit certification or documentation of abatement of
this violation as
normally required by 29 CFR 1903.19.
