T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employer did not ensure that forklift operators were protected from unexpected movement of trailers during loading/unloading. The employer utilized a Dok-Lok vehicle restraint system to secure the trailers; however, the system failed on numerous occasions. There have been several incidents where a forklift drove/fell off of a dock/trailer when the trailer was unexpectedly pulled away from the dock during loading/unloading. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a different system to secure the trailers during loading/unloading, such as wheel chocks. ABATEMENT VERIFICATION REQUIREDTION
