T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the seat belt on the Nissan Forklift was not utilized. The seat belt was trapped under the motor cover and was damaged. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a new seat belt and ensure its use.
