T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that employees were exposed to the hazard of working in a structure that had been damaged by a fire and subsequent water damage to the structural elements creating an unsafe structure that had the potential to collapse. The structure had been designated as unsafe for human habitation in June of 2006 by the City of Clarksville due to the poor condition of the structural elements. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the structure to comply with local building codes.ng
