North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to a struck-by falling objects
hazard:
a)production floor, the Walker-Bux Circular Electric Lift Magnet
below-the-hook device did not
have an adequate guard to prevent inadvertent contact with the power
control toggle lift/drop
switch located on the close proximity operated lift magnet, exposing
employees to a struck-by
falling objects hazard. On August 6, 2007, an employee was injured when
the electric lift
magnet suddenly released a solid steel bar weighing approximately 1245 lbs.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
provide guarding for the control switch in the "Lift" position to protect
it from being inadvertently
turned off, which is in accordance with Section 20-3.2.3(2) of ANSI/ASME
B30.20-1985, Below-the-
Hook Lifting Devices.

Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
provide training to employees with regard to the proper application,
operation, and maintenance of the
close proximity electric lift magnet to ensure that the below-the-hoof
lifting device is operated "only
by trained, appointed personnel," which is in accordance with Section
20-3.4.2. of ANSI/ASME
B30.20-1985, Below-the-Hook Lifting Devices.

Walker-Bux Circular Electric
Lift Magnet below-the-hook device were badly damaged and nearly illegible,
and the close
proximity operated electric lift magnet did not have a rated load
(capacity) tag attached to it,
exposing the employees to a falling objects hazard. On August 6, 2007, an
employee was
injured when the close proximity operated lift magnet suddenly released a
solid steel bar
weighing approximately 1245 lbs.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
attached a rated load (capacity) tag to the magnet, and order new labels
from the manufacturer and
properly affix the warning and cautionary labels to the electric lift
magnet to ensure the proper
application, operation, and maintenance of the close proximity electric
lift magnet, which is in
accordance with Section 20-3.2.1 of ANSI/ASME B30.20-1985, Below-the-Hook
Lifting Devices.
