Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the bucket of an excavator: (a) Location - Trench, side of building: The employer did not ensure that the operational path of a Volvo EC290B excavator bucket was clear of personnel and that the person directing the bucket was paying attention to where the bucket was being directed. A feasible and acceptable abatement method is to follow the Volvo EC290B Operators Manual, page 11, Move and Operate Machine Safely: Know the location of bystanders before moving, articulating or operating the machine. Additionally, create a work rule for operating the machine safely in accordance with the owners manual and train the employees to stay out of the path of the equipment.
