Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling steel storage racks and/or the components of the steel storage racks, including any products stored on the racks. a) Location - Facility On or about September 19, 2007, employees were exposed to the hazard of being struck by collapsing steel storage racks, and the material stored on them, while loading, unloading and working under overhead storage. Among other methods, feasible and acceptable means of abatement would include all of the following: 1) Repair or replace all damaged metal storage racks in accordance with the manufacturer's specifications, and ANSI MH16.2 - 1984(R1996). 2) Develop and implement an effective inspection and maintenance policy for all steel storage racks.
