Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Section 6(h) of the Puerto Rico Occupational Safety and Health Act;  Each
owner of any
premises used in whole or in part as a place of employment, did not comply
with all the
occupational safety and health standard and all rules, regulations and
orders issued pursuant to
this act, with respect to those parts of the premises under his control
and not under the control
of the employer:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Seccion 6(h) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
Cada dueno de
cualquier local usado todo o en parte como un sitio de empleo, no cumplio
con todas las normas
de salud y seguridad ocupacionales y todas las reglas, reglamentos y
ordenes emitidas de acuerdo
con esta ley, respecto a aquellas partes del local bajo su control y no
bajo el control del patrono:
At the exit gate of the Caparra Country Club parking, the gate was in bad
condition and
had the wheels defectives. The base that supported it was broken and fell
over the
Capitol Parking Management employee causing her injuries in one leg and
hip along with
contusions in differents parts of the body. The employer did not perform
the necessary
maintenance of the gate for the employees safety. The employee was a
cashier collected
the parking lot fees.
Hazard: Stroke by a gate.
Among other correcction methods, a feasible and acceptable method to
correct this
hazard is to fix the gate.
En el porton de salida del estacionamiento del Caparra Country Club, al
porton, el cual
estaba en malas condiciones y tenia las ruedas defectuosas, se le rompio
la base que lo
soportaba y cayo sobre la empleada de Capitol Parking Management,
causandole lesiones
en una pierna y cadera y contusiones en diferentes partes del cuerpo. El
patrono no
realizo el mantenimiento necesario al porton para la seguridad de los
empleados.
La
empleada era la cajera que cobraba por los servicios del estacionamiento.
Riesgo: Golpeado por un porton.
Entre otros metodos de correccion, un metodo factible y aceptable para
corregir este
riesgo es arreglar el porton.r
