Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At "AIJ-Centro de Detencion de Bayamon", kitchen area, employees performed food preparation works and were been exposed to heat stress (prolonged increase in deep body temperatures due exposure to high levels of heat). The interior Wet Bulb Temperature, Globe Temperature (WBGT) results in temperatures of over 27.7 centigrade degrees due to the air conditioner system was damaged. The employer had tried to fix the problem improvising an extractor in the window of the kitchen but the flow of the heat and humidity passed through the area affecting the employees. The other doors remained closed by reasons of security. The employees activity can be classified as moderate since all along the shift they have to be standing, walking or lifting full pots and casseroles. The following table shows the temperatures obtained in the areas of kitchen and served meals with the Heat Stress Monitor: AreaWet BulbDryGlobeWBGT INoC Cocina25.031.536.035.9 Cocina24.731.932.427.5 Cocina24.033.133.226.9 Cocina24.135.536.428.4 Cocina23.430.731.325.8 Servido de comidas23.330.630.725.5 Servido de comidas23.229.629.625.1 Among other methods, various feasible and acceptable methods to correct this hazard are: Repair the air conditioning system (engineering control) to reduce the WBGT interior under the indicated by the ACGIH (2001 TLVs y BEIs de 27.5 centigrade degrees). Also they should repair the hood extractors over the stoves so they capture the heat and humidity that comes from foods and to avoid that it crosses the kitchen. Meanwhile they need to implement mitigation controls that allow sufficient recovery and limit physiological strain such as: to provide accurate, verbal and written instructions, frequent training programs, and other information about heat stress and strain; encourage to drink small amount (approximately one cup) of cool water about every 20 minutes; to allow self-limitation of exposure or resting periods and encourage co-worker observation to detect signs and symptoms of heat strain in others; to monitor those who take medications that may compromise normal cardiovascular, blood pressure, regulation of body temperature, renal and sweat gland functions. En AIJ-Centro de Detencion de Bayamon, area de cocina, empleados realizaron trabajosde preparacion de alimentos y fueron expuestos a estres calorico (aumento prolongado en la temperatura interior del cuerpo por exposicion a altos niveles de calor.) Las temperaturas en el interior "Wet Bulb Temperature, Globe Temperature (WBGT)"resultaron sobre 27.7 grados centigrados, ya que el sistema de aire acondicionado estaba danado. El patrono habia tratado de corregir el problema improvisando un extractor en la ventana de la cocina pero la direccion del calor y la humedad atraviesan el area afectando a los empleados. Las demas puertas permanecian cerradas por motivos de seguridad. La actividad de los empleados se puede clasificar como moderada ya que estan todo el tiempo parados, caminando o levantando ollas y cacerolas llenas. La siguiente tabla muestra las temperaturas obtenidas con el "Heat Stress Monitor" en las areas de cocina y servido de comidas: AreaWet BulbDryGlobeWBGT INoC Cocina25.031.536.035.9 Cocina24.731.932.427.5 Cocina24.033.133.226.9 Cocina24.135.536.428.4 Cocina23.430.731.325.8 Servido de comidas23.330.630.725.5 Servido de comidas23.229.629.625.1 Entre otros metodos, varios metodos razonables y aceptables de corregir este riesgo son: Reparar el sistema de acondicionador del aire (control de ingenieria) para bajar el WBGT interior por debajo de lo indicado por la ACGIH (2001 TLVs y BEIs de 27.5 grados centigrados). Tambien se debe reparar los extractores de campana sobre las estufas para que capturen el calor y la humedad que resulta de la coccion de los alimentos y no atraviesen la cocina. Mientras tanto deben implementar controles generales que permitan suficiente recuperacion y limite la tension fisiologica tales como: proveer intrucciones escritas y verbales precisas, frecuentes programas de adiestramiento y cualquier otra informacion acerca de estres calorico y tension; fomentar el beber un volumen pequeno (aproximadamente una taza) de agua fria cada 20 minutos; permitir la auto-limitacion de exposicion o periodos de descanzo y fomentar la observacion de los companeros de trabajo para detectar senales y sintomas de tension por calor entre otros; monitorear a aquellos que toman medicamentos que puedan comprometer las funciones cardiovasculares normales, la presion sanguinea, la regulacion de la temperatura del cuerpo, las funciones renales y de la glandula del sudor.la

The employer did not provide training to his employees about the written protocol to handle domestic violence in the workplace, as required by the Act for the Implementation of a Protocol to Handle Domestic Violence Situations in the Workplace or Place of Employment, Act No. 217 of 2006. Hazard: Fatalities, injuries, and illnesses related to domestic violence in the workplace. Method to abate the hazard: The employer shall provide training to all the establishment's employees about the written protocol to handle domestic violence in the workplace. En AIJ-Centro de Detencion de Bayamon, area de cocina, empleados realizaron trabajos de preparacion de alimentos. El patrono no proveyo adiestramiento a sus empleados sobre el protocolo escrito para manejar situaciones de violencia domestica en el lugar de trabajo como lo requiere la Ley para la Implementacion del Protocolo para Manejar Situaciones de Violencia Domestica en el Sitio de Trabajo, Ley Num. 217 del 2006. Riesgo: Fatalidades, lesiones, y enfermedades relacionadas a la violencia domestica en el sitio de trabajo. Metodo de corregir el riesgo: El patrono tiene que proveer adiestramiento a todos los empleados sobre el protocolo escrito para el manejo de la violencia domestica en el sitio de trabajo.
