Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At the Caribe Automotive Distributors, Corp., warehouse; metal shelves up
to 4 levels,
a height with one level to over the other was 3 feet they contained
merchandise such as:
shock absorbers, hoses, oil and automobiles liquid wash, among others,
were not bolted
to the floor. The employees moved, stored and shipped merchandise from the
shelvess
by hand and/or using wheels carts, manual pallet jacks and a forklift
trademark HYSTER
40, model H40XMS, serial number D001H03468, type LP, as was the case. The
shelves
designed to be bolted to the floor, they had holes for screws and there
were many others
shelves that were bolted to the floor and walls in the same establishment.
Hazard: Falling of the shelfs and/or the merchandise above the employees.
Among other correction methods, a feasible and acceptable was anchor the
shelfs to the
floor.
En el almacen de "Caribe Automotive Distributors, Corp."; anaqueles de
metal de hasta
4 niveles, cuya altura entre un nivel a otro era de 3 pies y que contenian
mercancia tales
como: amortiguadores, mangas, aceites y liquidos de lavar carros, entre
otros, no estaban
atornillados al piso. Los empleados movian, despachaban y almacenaban
mercancia de
los anaqueles de forma manual y/o utilizando carros de ruedas, "pallets
jacks" manuales
o un montacarga marca "Hyster 40", modelo H40XMS, numero de serie
D001H03468U,
tipo LP, segun fuera el caso. Los anaqueles estaban disenados para estar
atornillados al
piso, ya que en su soporte tenian los espacios para colocarle los
tornillos y en el mismo
establecimiento habia muchos otros anaqueles que estaban atornillados
tanto al piso como
a las paredes.
Riesgo: Caida de los anaqueles y/o la mercancia encima de los empleados.
Entre otros metodos de correccion uno factible y aceptable seria anclar
los anaqueles al
piso.eles

At Caribe Automotive Distributors, Corp., the employer did not provide
training to his
employees ralated to the establishment of a written protocol to handle
domestic violence
in the workplace, as required by the Act for the Implementation of a
Protocol to Handle
Domestic Violence Situations in the Workplace or Place of Employment, Act
No. 217
of 2006.
Hazard: Fatalities, injuries, and illnesses related to domestic violence
in the workplace.
Method to abate the hazard: The employer shall provide training to all the
establishment's employees related to a written protocol to handle domestic
violence in
the workplace. Information is available at the Women's Advocate Office, A
Guide for
Employers: Domestic Violence in the Workplace and other references
provided during
the inspection.
En "Caribe Automotive Distributors, Corp.," el patrono no proveyo
adiestramiento a sus
empleados relacionado al establecimiento de un protocolo escrito para
manejar situaciones
de violencia domestica en el lugar de trabajo, como lo requiere la Ley
para la
Implementacion del Protocolo para Manejar Situaciones de Violencia
Domestica en el
Sitio de Trabajo, Ley Num. 217 del 2006.
Riesgo: Fatalidades, lesiones, y enfermedades relacionadas a la violencia
domestica en
el sitio de trabajo.
Metodo de corregir el riesgo: El patrono tiene que proveer adiestramiento
a
todos los
empleados del establecimiento relacionado con un protocolo escrito para el
manejo de la
violencia domestica en el sitio de trabajo. Hay informacion disponible en
la Oficina de
la Procuradora de la Mujer, Una Guia para Patronos: Violencia Domestica en
el Sitio de
Trabajo, y otras referencias provistas durante la inspeccion.
