Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: ANSI/SIA A92.9-1993, Paragraph 7.4: Users did not inspect and/or maintain the Mast Climbing Work Platform as required to ensure proper operation. The frecuency of inspection and maintance were not followed as determined by manufacturer's recommendation and were not compatible with operating conditions and the severity of the operating environment. Mast Climbing Work Platforms that were not in proper operating condition were not immediately removed from service until repaired. Repairs were not made by a qualified person and the repairs were not in conformance with the manufacturer's recommendations, or the equivalent entity's recommendations should the manufacturer no longer be in business. ANSI/SIA A92.9 -1993, Parrafo 7.4: Los usuarios no inspeccionaron ni mantuvieron el andamio de mastil como requeria asegurar operacion apropiada. La frecuencia de inspecciones y el mantenimiento no fueron seguidos como fue determinado en las recomendaciones del fabricante y no fue compatible con las condiciones del funcionamiento y la severidad del ambiente. Los andamios de Mastil no estaban en la condicion de funcionamiento apropiado no fueron removidos inmediatamente del servicio hasta que fuesen reparados. Las reparaciones no fueron hechas por una persona calificada y no estaban en conformidad con las recomendaciones del fabricante, o las recomendaciones de la entidad equivalentes si el fabricante ya no esta en el negocio. In no case shall the prime contractor be releived of overall responsibility for the compliance with the requirements of this part for all work to be performed under the contract. Reference: Multi-employer policy. Desarrollos Metropolitanos was the prime contractor and Marino Construction was a subcontractor that had employees exposed to the hazards at the Atlantins Construction Proyect in the facade located at the back side of the building. Desarrollos Metropolitanos as a General Contractor failed to exercise his authority in order to enforce their safety and health program at the entire proyect. As a result of the lack of enforcement, employees of subcontractor Marino Construction died in an occupational accident on the proyect. There was a mast scaffold rented by Deasarrollos Metropolitanos and used by Marino Construction plastereres. The scaffold was used by Marino Construction employees tobe able to reach the 18th floor were they were plastering exterior walls. The scaffold platform was at approximately 150 feet of height when another employee went to provide maintenance to the scaffold. The maintenance work consisted in changing one of the wheels that maintained elevated the platform. Meanwhile the plasterers kept working while the mechanic was repairing the scaffold. The scaffold Trademark was Hek, model MS Pro Max. It was a rainy day with strong winds when the mechanic took off the wheel to replace it with a new one. At this moment the scaffold platform came down in a free fall and the plasterers inside the platform died. The employer did not assure that the users of the scaffold inspected it, and mantained the Mast Climbing Work Platform following the manufacturer's recommendation or the ANSI/SIA A92.9-1993, to ensure proper operation. Neither the repairs were made by quialified person, following the manufacture's recomendations. Hazard: Scaffold failure, breaks or fell down while employees were using it. En ningun caso se relevara al contratista general de la responsabilidad general de cumplir con los requisitos de esta parte para todos los trabajos que se realizaran bajo el contrato. Referencia: Politica Multi-patronos Desarrollos Metropolitanos era el Contratista General en el Proyecto de construccion Atlantis y Marino Construction era el Sub-contratista que tenia empleados expuestos a riesgos en la parte posterior del edificio. Desarrollos Metropolitanos como contratista general fallo en ejercer su autoridad de forma que se asegurase el cumplimiento de su programa de seguridad y salud en el proyecto completo. Como resultado de la falta a esta aplicacion, empleados de Marino Construction murieron en un accidente ocupacional en el Proyecto. Habia un andamio de mastil que fue alquilado por Desarrollos Metropolitanos y era usado por albaniles de Marino Construction. Los empleados de Marino Construction usaron el andamio para poder alcanzar la pared exterior del piso 18 donde se encontraban empanetando. La plataforma del andamio de mastil se encontraban a una altura de aproximada de 150 pies cuando otro empleado fue a realizar trabajos de mantenimiento al andamio. El trabajo de mantenimiento consistia en cambiar una de las ruedas que mantenia la plataforma elevada. Los albaniles se mantuvieron trabajando mientras el mecanico se encontraba reparando el andamio. El andamio era marca Hek, Modelo MS Pro Max. El dia estaba lluvioso con vientos fuertes al momento que el mecanico saco la rueda para remplazarla por una nueva. En ese momento el andamio cayo en caida libre y los albaniles en la plataforma murieron. El patrono no se aseguro que los usuarios de la plataforma inspeccionaran y mantuviesen la plataforma de trabajo tipo mastil, siguiendo las recomendaciones del manufacturero o del ANSI/SIA A92.9-1993, para asegurar la operacion apropiada del equipo.
