Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: The NFPA 30 Flammable and Combustible Liquid Code 2008 Edition, is a Recognized Industry Standard of recommended practices, that provide fundamental safeguards for the storage, handling, and use of flammable and combustible liquids. a)At Caribbean Petroleum Refining in Bayamon employees that worked performing routine tasks such as tank operator, waste treatment operator, loading rack operator, amoung others were exposed or could be exposed to flammable and combustible release, fire and or explosion during the performance of there duties. At the tank farm area the employer stored gasoline, jet fuel, fuel oil and diesel, in above ground tanks, ranging from 500 to 500,000 barrels. The employer did not review the Operational hazard of a large Hydrocarbon release from on-site piping entering the process sewer and storm water sewer systems. Equipment hazards like the additional hazards created by the use of expansion joints on the gasoline transfer lines at the Cummins pump station area. Human factors analysis related to what could occur if operators did not follow instructions for conducting rounds or gauging tanks. Level reading erroneous at the tank gauge and at the operators console. Additional hazards created when operators had to read tank sight gauge levels during the night in low light conditions. Lack of formal written operating procedures for determining the level of storage tanks during filling operations. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow NFPA 30 - 6.4.1 Operation involving flammable and combustible liquids shall be reviewed to ensure that fire and explosion hazards resulting from the loss of containment of liquids are provided with corresponding fire prevention,fire control, and emergency action plans. The extent of fire prevention and control that is provided shall be determined in consultation with the authorities having jurisdiction or by means of an engineering evaluation of the the operation and aplication of sound fire protection and process engineneering principles. This evaluation shall include, but not be limited to the following: a.Analysis of the fire and explosion hazards of the operation. b.Analysis of applicable facility design requirements in Chapters17, 18, 19, 28, and 29. c.Analysis of applicable requirements for liquid handling, transfer, and use, as covered in Chapters 17, 18, 19, 28, and 29. El Codigo "NFPA 30 Flammable and Combustible Liquid" edicion 2008 es un reglamento de practicas reconocidas por la industria, que proporcionan las salvaguardias fundamentales para el manejo, almacenaje, y uso de liquidos flamables y combustibles. a)En Caribbean Petroleum Refining in Bayamon empleados que trabajaban realizando tareas tales como operador de tanque operador de tratamiento de aguas, operador de carga entre otras fueron expuestos o podrian estar expuestos a liberacion de productos quimicos flamables, combustible, fuego y/o explosion durante el desempeno de sus deberes. En el area de la granja el patrono almacenaba en tanques sobre el terreno gasolina, jet fuel, fuel oil y diesel, que tenian capacidad que fluctuaba entre 500 a 500,000 barriles. El patrono no reviso los riesgos operacionales asociados con un escape grande de gasolina por la linea dentro de las facilidades que entre al alcantarillado de aguas de proceso o el de agua de escorrentia. Riesgos adicionales de los equipos como el creado por el uso de expansiones en la linea de transferencia de gasolina en el area de bombeo de las bombas cummins. Analisis de los factores humanos relacionados a lo que podria ocurrir si el operador no seguia las instrucciones relacionadas a sus rondas o lectura de nivel de los tanques. Lecturas de nivel erroneas en el indicador de los tanques y en la consola de los operadores. Los riesgos adicionales creados cuando el operador tenia que leer el indicador de nivel del tanque durante la noche con poca visibilidad. Falta de procedimientos operacionales formal para poder determinar el nivel del tanques durante operaciones de llenado. Entre otros metodos, un metodo razonable y aceptable para corregir este riesgo es: 1.Seguir el NFPA 30 - 6.4.1 operaciones que contemplen el uso de liquidos inflamables y combustibles deben ser revisadas para asegurar que los riesgos de fuego y explosion resultantes de la perdida de contencion de liquidos son provistos con los correspondientes plan de control de fuego. El alcance de la prevencion y control de incendios se determinaran en consulta con la autoridad competente o por medio de una evaluacion tecnica de la operacion y la aplicacion de proteccion contra incendios adecuada y los principios tecnicos de los procesos. Esta evaluacion debera incluir, pero no ser limitada a lo siguiente: a.Analisis de la operacion para los riesgos de fuego y explosion. b.Analisis de los requisitos aplicables para el diseno de la facilidad contenidos en los Capitulos 17, 18, 19, 28 y 29.c.Analisis de los requisitos aplicables en el manejo, transferencia y uso de liquidos cubiertos en los Capitulos 17, 18, 19, 28 y 29.

The purpose of this standard is to consolidate a wide base of current industry experience, knowledge, information, and management practices into a cohesive standard compromising a range of best practices. a)At Caribbean Petroleum Refining in Bayamon employees that worked performing routine tasks such as tank operator, waste traetment operator, loading rack operator amoung others were exposed or could be exposed to flammable and combustible release, fire and or explosion during the performance of there duties. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow NFPA 30 - 21.7.1.1 Facilities with aboveground tanks that receive and transfer Class I liquids from mainline pipelines or marine vessels shall establish and follow formal written procedures to prevent overfilling of tanks. Employees were exposed or could be exposed to flammable and combustible release, fire and or explosionduring the performance of their duties. At the tank farm area the employer stored gasoline, jet fuel, fuel oil, and diesel in above ground tanks, ranging from 500 to 500,000 barrels. The employer did not have a formal written operating procedures for safely filling of storage tanks and for the transfering according to API 2350- 2.1.1. The employer provided documents that established which valves had to be closed or opened during the fill or transfer operations from tank to tank or from dock to tank, but did not mention in which order to proceed neither indicated any safety measure. At the tank farm area the employer stored gasoline, jet fuel, fuel oil, and diesel in above ground tanks, ranging from 500 to 500,000 barrels. Weed and grass were not controlled in the dike areas and surrounding areas of the tank according to NFPA 30 - 6.9.4. During the inspection walk-around performed on 11-05-09, 12-04-09, 2-3-10, and 2-23-10 it was observed that a significant amounts of grass and weed in close proximity and adjacent to the dikes and surrounding areas had uncontrolled vegetation growth or were actively growing or were burned during the incident. Also the employer provided documents of inspections that stated the vegetacion growth problems and how on occasion it even affected walking of employees in the area. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow NFPA 30 - 6.9.4 Ground areas around facilities where liquids are stored, handled, or used shall be kept free of weeds, trash, or other unnecessary combustible materials. El codigo NFPA 30 Liquidos Inflamables y Combustibles edicion 2008 es un reglamento de practicas reconocidas por la industria, que proporcionan las salvaguardas para el manejo, almacenaje y uso de liquidos inflamables y combustibles. a)Empleados que trabajaban en CAPECO, realizando tareas rutinarias tales como: operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otros fueron o podrian haber estado expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion. En el area de la granja se almacenaba en tanques sobre el terreno gasolina, "jet-fuel", "fuel oil" y diesel, con capacidades que fluctuaban entre 500 a 500,000 barriles. El proposito de este reglamento es consolidar con una base considerable de experiencia en la industria actualizado, conocimiento, informacion y practicas gerenciales en un reglamento consistente comprometiendo una gama de las mejores practicas. a)Empleados que trabajaban en CAPECO, realizando tareas rutinarias tales como: operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otros fueron expuestos o podrian haber estado expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion.En el area de la granja se almacenaba en tanques sobre el terreno gasolina, "jet-fuel", "fuel oil" y diesel, con capacidades que fluctuaban entre 5,000 a 500,000 barriles. La Maleza y vegetacion no fueron controladas en las areas de los diques y en las areas adyacentes de acuerdo al API 2610 - 9.2.11. Durante los recorridos hechos el 5/nov/09, 4/dic/09, 3/feb/10 y 23/feb/10 se observo una cantidad significativa de vegetacion y maleza bien cerca y en las areas adyacente a los diques y alrededores que tenian crecimiento descontrolado de vegetacion que estaba creciendo activamente o que habia sido quemada durante el incidente. Ademas patrono proveyo documentos de inspecciones que mencionaban el problema de crecimiento de la vegetacion y como en ocasiones afectaba hasta el caminar de los empleados por el area. Ver Carpeta 3 pestana 1 "work diary" OSHA PRODUCTION 12-23-0 pagina 88, pestana 2 "Maintenance work order" T-822 OSHA PRODUCTION No.2 11/20/09 page 2265 y pestana 2(b) OSHA PRODUCTION No.2 11-20-09 hojas de Cotejo inspeccion mensual para tanques de almacenamiento a granel S-2 pagina 358 S-4 pagina 360, S-6 pagina 363, hoja mensual bombas X-3 pagina 367. Cuando la vegetacion y maleza no son controladas estas pueden hacerse parte de la carga de combustible en caso de comenzar un fuego en el area, anadiendo a la dispersion del fuego. Entre varios metodos, un metodo de correccion aceptable y factible para corregir este riesgo es: 1.Seguir el API 2610 - 9.2.11 Medidas de control de maleza deben ser tomadas para asegurar que ninguna vegetacion adyacente a o dentro del area del dique sea mantenido a un nivel que no posea una amenaza a un control de fuego eficaz.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: The NFPA 30 Flammable and Combustible Liquid Code 2008 Edition, is a Recognized Industry Standard of recommended practices, that provide fundamental safeguards for the storage, handling, and use of flammable and combustible liquids. a)Employees that worked at CAPECO performing routine task such as tank operator,waste treatment operator, loading rack operator, among others were exposed or could be exposed to flammable and combustible release, fire and or explosion. At the tank farm area the employer stored gasoline, jet fuel, fuel oil and diesel, in above ground tanks, ranging from 500 to 500,000 barrels. The expansion joint upstream (16" gasoline service at approximately 80-90 psi service) from the YP-7A Cummins Pump catastrophically failed and came apart as either a primary cause or secondary cause (due to the fire) of the incident. CAPECO did not have any record of the designed and installation of this joint according to NFPA 30 - 27.5.1.2. See document response to document request 2/18/10. Also there is no record of maintenance to this joint. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow NFPA 30 - 27.5.1.2 Joints shall be designed and installed so that the mechanical strength of the joint will not be impaired if exposed to a fire. El codigo, NFPA 30 Liquidos Inflamables y Combustibles edicion 2008, es un reglamento de practicas reconocidas por la industria, que proporcionan las salvaguardas fundamentales para el manejo, almacenaje, y uso de liquidos inflamables y combustibles. a) Empleados que trabajaban en CAPECO, realizando tareas rutinarias tales como: operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otros fueron expuestos o podrian haber estado expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion. En el area de la granja el patrono almacenaba en tanques sobre el terreno gasolina, "jet-fuel", "fuel oil" y diesel, con capacidades que fluctuaban entre 500 a 500,000 barriles. La junta de expansion ascendente (servicio degasolina de 16" a una presion de servicio aproximadamente de 80-90 psi) de la bomba Cummins YP-7A fallo catastroficamente y se rompio, ya fuera como causa primaria o secundaria debido al fuego durante el incidente. Capeco no tenia ningun registro del diseno e instalacion de esta expansion de acuerdo con NFPA 30 - 27.5.1.2. Ver documento respuesta a documento requerido el dia 2/18/10 donde se acepta que Caribbean Petroleum no tenia documentacion a estos efectos. Tampoco no existen documentos de mantenimiento de esta expansion. Entre varios metodos, uno metodo de correccion aceptable y factible para corregir este riesgo es: 1.Seguir el NFPA 30 - 27.5.1.2 Las juntas deben ser disenadas e instaladas de modo que la fortaleza mecanica de la junta no sea perjudicada si se expone a un fuego.

The purpose of this standard is to consolidate a wide base of current industry experience, knowledge, information, and management practices into a cohesive standard compromising a range of best practices. a)Employees that worked at CAPECO performing routine task such as tank operator,waste treatment operator, loading rack operator, among others were exposed or could be exposed to flammable and combustible release, fire and or explosion. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 4.3.1.1 Systems and Procedures. An owner/user organization is responsible for developing, documenting, implementing, executing, and assessing piping inspection systems and inspection procedures that will meet the requirements of this inspection code. These systems and procedures will be contained in a quality assurance inspection/repair management system and shall include: a.organization and reporting structure for inspection personnel; b.documenting and maintaining inspection and quality assurance procedures; c.documenting and reporting inspection and test results; d.developing and documenting inspection plans; e.developing and documenting risk-based assessments; f.developing and documenting the appropriate inspection intervals; g.corrective action for inspection and test results; h.internal auditing for compliance with the quality assurance inspection manual; i.review and approval of drawings, design calculations, and specifications for repairs, alterations, and ratings; j.ensuring that all jurisdictional requirements for pipinginspection, repairs, alterations, and rerating are continuously met; k.reporting to the authorized piping inspector any process changes that could affect piping integrity; l.training requirements for inspection personnel regarding inspection tools, techniques, and technical knowledge base; m.controls necessary so that only qualified welders and procedures are used for all repairs and alterations; n.controls necessary so that only qualified nondestructive examination (NDE) personnel and procedures are utilized; o.controls necessary so that only materials conforming to the applicable section of the ASME Code are utilized for repairs and alterations; p.controls necessary so that all inspection measurement and test equipment are properly maintained and calibrated; q.controls necessary so that the work of contract inspection or repair organizations meet the same inspection requirements as the owner/user organization; r.internal auditing requirements for the quality control system for pressure-relieving devices. API - 570 - NOV 2009 es un reglamento de practicas reconocidas por la industria que abarca procedimientos de inspeccion, clasificiacion, reparacion y alteracion para sistemas de tuberias metalicas y de plastico reforzado con fibra de vidrio y sus dispositivos de liberacion de presion conectados que hayan sido puesto en servicio. a)En Caribbean Petroleum Refining en Bayamon empleados que trabajaban realizando tareas tales como operador de tanque operador de tratamiento de aguas, operador de carga entre otras fueron expuestos o podrian estar expuesto a liberacion de productos quimicos inflamables, combustible,fuego y/o explosion durante el desempeno de sus deberes. El patrono no desarrollo un sistema de inspeccion y procedimientos de inspeccion de tuberias que cumplieran con los requisitos de inspeccion del codigo API 570 4.3.1.1 Sistema y Procedimientos. Un metodo seguro entre otros metodos aceptables para corregir estos riesgos son: 1.seguir los requerimientos del API 570 4.3.1.1 Sistemas y procedimientos. Una empresa duena/usuaria es responsable del desarrollo, documentacion, implementacion, ejecucion y evaluacion de los procedimientos y sistemas de inspeccion de tuberias de modo que cumplan con los requisitos de este codigo. Estos sistemas y procedimientos seran contenidos en un sistema gerencia de control de calidad de inspeccion/reparacion que debe incluir lo siguiente: a.la estructura de la configuracion y la presentacion de informes para el personal de inspeccion; b.documentado y manteniendo inspecciones y procedimientos de control de calidad; c.documentado y manteniendo inspecciones y resultados de las pruebas; d.planes de inspeccion; e.desarrollando y documentando evaluacion basada en los riesgos; f.desarrollando y documentando los intervalos de inspeccion apropiados; g.medidas correctivas para las inspecciones y los resultados de pruebas; h.auditoria interna conforme al manual de inspeccion de evaluacion de calidad; i.revision y aprobacion de planos, calculo de diseno y especificaciones para reparaciones, alteraciones y reclasificaciones; j.asegurar que todos los requisitos jurisdiccionales para inspecciones, reparaciones, alteraciones y reclasificacion de tuberias sean continuamente satisfechas; k.reportando al inspector autorizado de tuberias cualquier cambio en procesos que pudieran afectar la integridad de la tuberia; l.requisitos de adiestramiento para el personal de inspeccion relacionado a herramientas de inspeccion, tecnicas y el conocimiento tecnico basico; m.los controles necesarios de modo que solo soldadores calificados y procedimientos sean utilizados para todas las reparaciones y alteraciones; n.los controles necesarios de modo que solo personal calificado en pruebas no destructivas (NDE) y procedimientos sean utilizados; o.los controles necesarios de modo que solo materiales conforme a la seccion aplicable del Codigo de ASME sean utilizados para reparaciones y alteraciones; p.los controles necesarios de modo que todas los calculo de inspeccion y equipos de pruebas sean debidamente conservados y calibrados; q.los controles necesarios de modo que los trabajos de inspeccion subcontratados o la empresa que repara satisfaga los mismos requisitos que la empresa duena/usuaria; r.los requisitos de auditoria interna para los sistemas de control de calidad para los equipos de liberacion de presion.on

API - 570 - NOV 2009 is a Recognized Industry Standard of recommended practices that covers inspection, rating, repair, and alteration procedures for metallic and fiberglass reinforced plastic (FRP) piping systems and their associated pressure relieving devices that have been placed in-service. a)Employees that worked at Caribbean Petroleum Refining in Bayamon performing routine task such as tank operator, waste treatment operator,loading rack operator among others, were expose or could be exposed to flammable and combustible spill or release,fire and or explosion. The employer did not categorize product piping into classes for the purpose of prioritizing and scheduling piping inspections. In 2007 the employer inspected aboveground pipeline from dock to plant but did not inspected the rest of the pipeline inside the facility. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 6.3.4.1 Piping Service Classes. All process piping system shall be categorized into different piping classes. Such a classification system allows extra inspection efforts to be focused on piping systems that may have the highest potential consequences if failure or loss of containment should occur. Classifications should be based on potential safety and environmental effects should a leak occur. Owner/users shall maintain a record of process piping fluids handled, including their classifications. API 750 and NFPA 704 provide information that may be helpful in classifying piping systems according to the potential hazards of the process fluids they contain. API - 570 - NOV 2009 es un estandar de practicas reconocidas por la industria Abarca procedimientos de inspeccion, rating, reparacion y alteracion para sistemas de tuberias metalicas y de plastico reforzado con fibra de vidrio y sus dispositivos de liberacion de presion conectados que hayan sido puesto en servicio. a)Empleados que trabajaban en Caribbean Petoleum Refinig en Bayamon, realizando tareas de rutina tales como operador de tanque, operador de tratamiento de agua, operador de area de carga entre otros fueron o podrianestar expuesto a derrame o liberacion de productos quimicos inflamables, combustible, fuego y/o explosion. El patrono no categorizo la tuberia de productos en clases para el proposito de prioritizar y asegurar las inspecciones de estas. En el 2007 el patrono inspecciono las tuberias sobre el terreno desde el muelle hasta la planta pero no inspecciono el resto de la tuberia dentro de las facilidades. Entre otros metodos, un metodo de correccion razonable y aceptable de corregir este riesgo es: 1.Seguir el API 570 - 6.3.4.1 todo sistema de tuberia debe ser categorizado en diferentes clases. La Clasificacion debe ser basada en los riesgos potenciales de seguridad y eventos ambientales de ocurrir un liqueo. Patrono/usuario debe mantener un registro de todas las tuberias de fluidos que manejan, incluyendo sus clasificaciones. El API 750 y el NFPA 704 proveen informacion que puede ser de ayuda en la clasificacion de sistemas de tuberias de acuerdo a los riesgos potenciales de los productos liquidos que contengan.

In the Tank Farm Area there was approximately 45 above ground steel tanks ranging in capacity from 500 to 500,000 barrels which were used for the storage and distribution of gasoline, diesel, fuel oil, and jet fuel. Products were transfered to and from the tanks via above and under ground pipelines. The employer did not have an inspection system for the entire system of pipes in service, to determine the integrity of product transfer piping at the facility. The employer provided some documentation of daily and monthly inspection for visible leak to the Pipes racks. This inspection was to comply with SPCC but did not comply with the API 570 - 5.5.4 External Visual Inspection. In 2007, the employer inspected aboveground pipeline from dock to plant but did not inspected the entire pipeline system inside the facility. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 5.5.4 External Visual Inspection. An external visual inspection is performed to determine the condition of the outside of the piping, insulation system, painting, and coating systems, and associated hardware; and to check for signs of misalignment, vibration, and leakage. External inspections shall include surveys for the condition of piping hangers and supports. Instances of cracked or broken hangers, "bottoming out" of spring supports, support shoes displaced from support members, or other improper restraint conditions shall be reported and corrected. Bellows expansion joints should be inspected visually for unusual deformations, misalignment, or displacements thatmay exceed design. Non standard piping components (e.g flex hoses) may have different degradation mechanisms. Specialist engineers or manufacture data sources may need to be consulted in developing valid inspection plans for these components. The inspector should examine the piping system for the presence of any field modifications or temporary repairs not previously recorded on the piping drawings and/or records. The inspector also should be alert to the presence of any components that may be unsuitable for long-term operation. Otros metodos suplementarios que pueden ser necesarios basados en condiciones particulares y especificas del lugar incluyen, pero no se limitan a, deteccion de vapores, ultrasonico, medidas de espesor de la pared y pruebas de presion.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: API - 570 - NOV 2009 is a recognized Industry standard of recommended practices that Covers inspection, rating, repair, and alteration procedures for metallic and fiberglass reinforced plastic (FRP) piping systems and their associated pressure relieving devices that have been placed inservice. a)Employees that worked at Caribbean Petroleum Refining in Bayamon performing routine task such as tank operator,waste treatment operator, loading rack operator, among others were or could be exposed to flammable and combustible release,fire and or explosion. In the Tank Farm Area there was approximately 45 above ground steel tanks ranging in capacity from 500 to 500,000 barrels which were used for the storage and distribution of gasoline, diesel, fuel oil, and jet fuel The employer did not develop an inspection plan to inspect the mechanical integrity for all piping systems (flanges, valves, pumps, etc.) The employer provided a copy of a PSM program that mentioned the mechanical integrity. At the same time they informed us that the program was current until the year 2000 when they stopped the refining process and only mantained the tank farm operations, and accordingly they were not using the PSM program anymore. Also they provided some documents of some piping inspections; see binder 3 tab 2(c) OSHA PRODUCTION No.2 11/20/09 sheet P-2, P-4, P-6, X-1 pages 357, 361, 364, and 365. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 5.1.1.1 Development of an Inspection Plan. An inspection plan shall be established for all piping systems within the scope of this code. The inspection plan shall be developed by the inspector and/or engineer. API - 570 - NOV 2009 es un reglamento de practicas reconocidas por la industria que abarca procedimientos de inspeccion, clasificacion, reparacion y alteracion para sistemas de tuberias metalicas y de plastico reforzado con fibra de vidrio y sus dispositivos de liberacion de presion conectados que hayan sido puesto en servicio. a)Empleados que trabajaban en Caribbean Petroleum Refining en Bayamon,realizando tareas rutinarias tales como: operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otros, fueron o podrian estar expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion. En la granja de tanques habian alrededor de 45 tanques de acero sobre el terreno, con capacidades que fluctuaban entre 500 a 500,000 barriles los cuales se utilizaban para almacenamiento y distribucion de gasolina, diesel, aceite combustible y combustible para aviones. El patrono no desarrollo un plan de inspeccion, para inspeccionar la integridad mecanica de todo el sistema de tuberia ("flanges", valvulas, bombas, etc.). El patrono proveyo una copia del Programa de PSM que menciona integridad mecanica. Al mismo tiempo nos informaron que el programa se mantuvo al dia hasta el ano 2000, luego de esto ellos no tenian proceso de refineria y solo se quedaron operacion de la granja de tanques, por consiguiente pararon de usar el programa de PSM. Ademas estos proveyeron algunos documentos de algunas inspecciones de tuberias; ver carpeta 3 pestana 2(c) OSHA PRODUCTION NO 2 11/20/09 sheet P-2, P-4, P-6, X-1 paginas 357, 361, 364y 365. Un metodo seguro entre otros metodos aceptables para corregir este riesgos es: 1.Seguir el API 570 - 5.1.1.1 Desarrollo de un Plan de Inspeccion. Un plan de inspeccion debe ser establecido para todos los sistemas de tuberias dentro del alcance de este codigo. El plan de inspeccion debe ser desarrollado por un inspector y/o ingeniero.

At the tank farm area the employer stored gasoline, jet fuel, fuel oil and diesel, in above ground tanks, ranging from 500 to 500,000 barrels.The employer did not have written maintenance procedures for tanks and their appurtenances including overfill protection devices. A number of tanks (504, 411, 455, 103, 104, 106, 107, 201, 408, 453, 454, 302, 403, 501, 601, 604) with level indicators at the operator console in the control room were not functional at the time of the event due to maintenance issues. See binder 3 tab 2 OSHA PRODUCTION No.2 11/20/09 documents T- 830 page 195, T-827 page 200, T-823 page 2264 among others. Additionally, tank levels readings did not correspond between tank level readings at operator consoles and gages at the tank and actual levels contained in some tanks due to calibration issues. See binder 3 tab 2 OSHA PRODUCTION No.2 11-20-09 documents: T-828 page 199, T-829 page 198, T-812 page 2275, T-811page 2276, T-809 page 2278 amoung others. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow NFPA 30 - 21.8.6 Storage tanks and their appurtenances, including normal vents, emergency vents, overfill prevention devices, and related devices shall be maintained to ensure that they function as intended in accordance with written procedures. There was a leak of the underground gasoline product pipe northwest of the YP-7A Cummins pump and was not investigated. PR OSHA requested this report on 2/18/10, but was not provided by the employer at any time during PR OSHA inspection process. . Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 7.9 Piping Failure and Leak Reports. Leaks and failures in piping that occur as a result of corrosion, cracking or mechanical damage shall be reported and recorded to the owner-user. As with other piping failures, leaks and failures in piping systems shall be investigated to identify and correct the cause of failure. Temporary repairs to piping systems shall be documented in the inspection records. Hubo una filtracion en la tuberia de transferencia de gasolina al noroeste de la bomba cummin YP-7A, que no fue investigada. PR OSHA le solicito dicho informe el 2/18/2010, pero el mismo no fue provisto por el patrono durante el proceso de inspeccion de PR OSHA. Un metodo seguro entre otros metodos aceptables para corregir este riesgos es: 1.Seguir el API 570 - 7.9 Reportes de Fallas en Tuberia y Escapes. Escapes y fallas en tuberias que ocurren como resultado de corrosion, agrietamiento o dano mecanico deben ser reportados y registrados al dueno/usuario. Como con otras fallas en las tuberias, escapes y fallas en los sistemas de tuberias deben ser investigados para identificar y corregir la causa de la falla. Reparaciones temporeras a sistemas de tuberia deben ser documentadas en los registros de inspeccion.s

Piping system owners and users shall maintain permanent and progressive records of their piping systems and pressure-relieving devices. Permanent records will be maintained throughout the service life of each piping system. As a part of these records, progressive inspection and maintenance records will be regularly updated to include new information pertinent to the operation, inspection, and maintenance history of the piping system. See also API 574 for more information of piping system records. Duenos y usuarios de sistemas de tuberias deben mantener registros permanente y progresivos de sus sistemas de tuberias y equipos de liberacion de presion. Registros permanentes seran mantenidos durante la vida util de cada sistema de tuberia. Como parte de estos registros, inspecciones progresivas y registros de mantenimiento seran regularmente actualizadas para incluir informacion reciente pertinente a la operacion, inspeccion e historial de mantenimiento del sistema de tuberia. Piping system and pressure-relieving device records shall contain four types of information pertinent to mechanical integrity as follows. a.Fabrication, Construction and Design Information to the Extent Available - For example, MDRs, MTRs, weld maps, WPS/PQR, design specification data, piping design calculations, NDE records, heat treat records, pressure-relieving sizing calculations and construction drawings. b.Inspection History - For example, inspection reports, and data for each type of inspection conducted (e.g. internal, external, thickness measurements), and inspection recommendations for repair. Inspection reports shall document the date of each inspection and/or examination, the date of the next scheduled inspection, the name (or initials) of the person who performed the inspection and/or examination, the serial number or otheridentifier of the equipment inspected, a description of the inspection and/or examination performed, and the results of the inspection and/or examination. Piping RBI records should be in accordance with API 580. c.Repair, Alteration, and Re-rating Information - For example: 1.repair and alteration forms if prepared 2.reports indicating that piping systems still in-service with either identified deficiencies, temporary repairs or recommendations for repair, are suitable for continued service until repairs can be completed; and 3.rerating documentation (including rerating calculations and new design conditions d.Fitness-For-Service Assesment Documentation Requirements are Described in API 579-1/ASME FFS-1. Registros de sistemas de tuberias y equipos de liberacion de presion deben contener cuatro tipos de informacion pertinentes a integridad mecanica como sigue: a.Fabricacion, Construccion e Informacion de Diseno al alcance disponible - Por ejemplo, MDRs, MTRs, planos de soldadura, WPS/PQR, datos de la especificacion de diseno, computos deldiseno de la tuberia, registros NDE, registros de tratamientos con calor, computos de las dimensiones de liberacion de presion y dibujos de construccion. b.Historial de Inspeccion - Por ejemplo, reportes de inspecciones y los datos para cada tipo de inspeccion conducida (ej. medidas de grosor internas, externas), y las recomendaciones para reparaciones.Los reportes de inspecciones deben documentar la fecha de cada inspeccion y/o examen, la fecha de la proxima inspeccion en calendario, el nombre (o iniciales) de la persona que realizo la inspeccion y/o examen, el numero de serie u otro identificador del equipo inspeccionado, una descripcion de la inspeccion y/o examen llevado a cabo y los resultados de la inspeccion y/o examen. Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: API - 570 - NOV 2009 is a recognized Industry standard of recommended practices covers inspection, rating, repair, and alteration procedures for metallic and fiberglass reinforced plastic (FRP) piping systems and their associated pressure relieving devices that have been placed in-service. a)Employees that worked at Caribbean Petroleum Refining in Bayamon performing routine task such as tank operator, waste treatment operator, loading rack operator, among others were or could be expose to flammable and combustible releases, fire and or explosion. Since 2000 the refinery process area has been out of service but the facility continues with the storage and distribution of gasoline, diesel, fuel oil, and jet fuel. At the Tank Farm Area there was approximately 45 above ground steel tanks ranging in capacity from 500 to 500,000 barrels. The products were transfer to and from the tanks via above and underground pipelines. The employer did not maintain all the required records of piping inspections. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 570 - 7.8 Inspection Records for External Inspections. Results of external piping system inspections shall be documented. A narrative or checklist format is recommended when documenting inspection results. The location of CUI inspections, either by insulation removal or NDE, should be identified. The location may be identified by establishing a CML on the appropriate inspection ISO or with marked-up construction ISOs and narrative reports. La localizacion de las inspecciones CUI, ya sean por remocion o NDE deben ser identificadas. La localizacion puede ser identificada estableciendo CML en la inspeccion respectiva de ISO o con los reportes senalados de ISOs y narrativos.

Since 2000 the refinery process area has been out of service but the facility continues with the storage and distribution of gasoline, diesel, fuel oil, and jet fuel. Among other methods, one fesible and acceptable abatement method to correct this hazard is: 1.Develop accurate and up-to-date P&ID based on an actual survey of the as built condition of the bulk plant facility in accordance with ASME A13.1. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 653 - 6.4.1.2 All tanks shall have a formal internal inspection conducted at the intervals defined by 6.4.2. The authorized inspector who is responsible for evaluation of a tank must conduct a visual inspection and assure the quality and completeness of the nondestructive examination (NDE) results. If the internal inspection is required solely for the purpose of determining the condition and integrity of the tank bottom, the internal inspection may be accomplished with the tank in-service utilizing various ultrasonic robotic thickness measurement and other on-stream inspection methods capable of assessing the thickness of the tank bottom, in combination with methods capable of assessing tank bottom integrity as described in 4.4.1. Electromagnetic methods may be used to supplement the on- stream ultrasonic inspection. If an in-service inspection is selected, the data and information collected shall be sufficient to evaluate the thickness, corrosion rate, and integrity of the tank bottom and establishthe internal inspection interval, based on tank bottom thickness, corrosion rate, and integrity, utilizing the methods included in this standard. An individual, knowledgeable and experienced in relevant inspection methodologies, and the authorized inspector who is responsible for evaluation of a tank must assure the quality and completeness of the in-service NDE results. API 653 - Abril 2009 Abarca tanques de almacenamiento de acero construidos de acuerdo al API 650 y su antecesor API 12C. Este provee requisitos minimos para el mantenimiento de la integridad de dichos tanques despues de haber sido puestos en servicio y trata inspecciones, reparaciones, alteraciones, relocalizaciones y reconstrucciones. a)En "Caribbean Petroleum Refining" en Bayamon (CAPECO), empleados que trabajaban realizando tareas rutinarias tales como operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otras fueron o podrian estar expuestos a liberacion de productos quimicos inflamables, combustible, fuego y/o explosion durante el desempeno de sus deberes. An owner/operator who has obtained data on the thickness and condition of the tank bottom during an internal inspection may calculate the interval until the subsequent internal inspection using the measured tank bottom corrosion rate and the minimum remaining thickness in accordance with 4.4.7. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Follow API 653 - 6.8.1 General. Inspection records form the basis of a scheduled inspection/maintenance program. The owner/operator shall maintain a complete record file consisting of three types of records, namely: construction records, inspection history, and repair/alteration history. API 653 - Abril 2009 Abarca tanques de almacenamiento de acero construidos de acuerdo al API 650 y su antecesor API 12C. Este provee requisitos minimos para el mantenimiento de la integridad de dichos tanques despues de haber sido puestos en servicio y trata inspecciones, reparaciones, alteraciones, relocalizaciones y reconstrucciones. a)Empleados que trabajaban en CAPECO, realizando tareas rutinarias tales como: operador de tanque, operador de tratamiento de aguas, operador de area de carga, entre otros fueron o podrian haber estado expuestos a liberacion deproductos quimicos inflamables, combustible, fuego y/o explosion. PR OSHA le requirio copia de los registros del historial de las inspecciones y los representantes patronales indicaron que ellos no tenian ninguna y/ o no habia ninguna que ellos tuviensen para entregar. (Documentos Solicitados el 18/02/10). Entre otros metodos, un metodo razonable y aceptable para corregir este riesgo es: 1.Seguir el API 653 - 6.8.1 - General. Los expedientes de inspeccion establece la base de un programa organizado de inspeccion/mantenimiento. El dueno/operador debe mantener un archivo de expedientes consistiendo de tres tipos de registros, a saber: registros de construccion, antecedentes de inspeccion y antecedentes de reparacion/alteracion.to.
